ORDER:

          The Self Sufficiency Scheme  intended to create infrastructural facilities on a time bound basis to hasten the economic activity, is being implemented in the Panchayat Union areas in this State.  The Government have decided that this Self Sufficiency Scheme  be extended to the Town Panchayat area also.  The 620 Town Panchayats in the State will be covered by the above the Government have selected 146 Town Panchayats for the implementation of Self Sufficiency Scheme  in the first batch in 1982-83 and the remaining Town Panchayats will be covered under the scheme in 1983-84 and 1984-85.

2.    Under the Self Sufficiency Scheme  for Town Panchayats the following essential basic amenities will be implemented.

1.Protected Drinking Water Supply

2.Link Roads.

3.Culverts.

4.Pathways to burning ghats/ Burial Ground from Adi Dravidar Colonies.

5 .Street Lighting in habitations of weaker communities.

6.Construction of Dhobikhanas.

3.    The Self Sufficiency Scheme  will be implemented in the Town Panchayat areas under the immediate supervision of the Executive  Officers of the Town Panchayats under the technical guidance and supervision of the Union Engineers was hitherto attending to the works of Town Panchayats also.  There works will be supervised and guided by the District Town Panchayat Officer who are designated as Regional Directors under the control of the Collectors.   Thus the responsibility of implementing the Self Sufficiency Scheme  is entrusted to the Collector of the District who will monitor the scheme and watch the progress and reportit to the Government and the Director of Town Panchayats.

4.    A sum of Rs. 5.00 Crores has been provided in the Budget for 1982-83 for implementing  the Self Sufficiency Scheme. Sanction is accorded for sanction of Rs. 3,42,000/- (Rupees Three lakhs and forty two thousands only) to implement the Self Sufficiency Scheme  to each of the first batch of 146 Town Panchayats.  The funds allocated above should not be diverted for any other programmes.  The Governmentr direct that the Town Panchayats shoul also pay contribution as indicated below while executing the works taken up under the Self Sufficiency Scheme .

5.    Sanction is also accorded for the employment of the following staff from the date of employment or till 31.3.83 untill the need cases as whichever is earlier for implementing the scheme.

6.    The incumbents of the above posts will be eligible for the usual allowance.

7.    The expenditure on the pay and allowance for the above posts will be debited to the Head of Account "314 - P.d. -A- General -AA.  Direction and Administration I non Plan - AJ. Regional Directorate of Town Panchayats - 314 A J 0063".

8.    Orders regarding the fixation of physical and financial targets and the head of account to which a sum of Rs. 5 crores sanctioned will be debited to will be issued separately.

NOTES

  1. The Government issued orders constituting a separate Directorate of Town Panchayats to be exclusively in charge of the administration of Town Panchayats, Vide  G.O.Ms.No.828 RD&LA Dated 7.5.81.

 

  1. Consequent on the formation of separate Directorate of Town Panchayats, a special rules for Tamilnadu Town Panchayats Subordinate service was issued by the Government vide their G.O.Ms.No.270 RD & LA Dated 4.4.90

 

  1. Before issue of service rules (G.O.270 RD & LA Dated 4.4.90) the service of the Executive Officer, Town Panchayats were governed by G.O.Ms.No.1163 RDLA Dated 10.6.76 and subsequent amendments & Classifications issued from time to time.

 

  1. Before issue of separate service rules vide G.O.Ms.270 RDLA Dated 4.4.90, the post of Executive Officer, Selection Grade was feeder category to the post of Head Assistant/Additional Panchayat Officer/ Ministerial Superintendent in the office of the Director of Town Panchayats.

                 (See Government letter 37559/E2/83-2 RDLA Dated 18.5.83)

 

  1. While issue of service rules, the post of Head Assistant/Ministerial Superintendent/Additional Panchayat Officer and Executive Officer selection grade were made equal.  Vide G.O.Ms.No.270 RDLA Dated 4.4.90

 

  1. Based on G.O.270 RDLA Dated 4.4.90 a inter-se-Seniority list was prepared by Director of Town Panchayats vide his proceedings Roc.28826/90/A3 Dated 7.4.92.  taking into account of their entry into the respective posts. (Vide Executive Officer Selection Grade, Head Assistant, Additional Panchayat Officer, Ministerial Superintendent in the office of the Director of Town Panchayats)

 

  1. Aggrieved by the above seniority list, Thiru R. Jayapal preferred an appeal denoting the saving clause providing in rule 10 of Tamilnadu Town Panchayats Subordinate Service  and rule 35( c ) of Tamilnadu State and Subordinate service rules to revise his seniority.

 

  1. The saving clause provided (rule 10) in G.O.Ms.No.270 RDLA Dated 4.4.90 says that

" Nothing contained in these rules shall adversely affect the persons holding any of the posts referred to in these rules on the date of issue of these rules".

 

  1. Rules 35( c ) of Tamilnadu State and subordinate service rules says that

" Where a member of any service , class, category or grade is reduced to a lower service, class, category or grade he shall be placed at the top of the latter unless the authority ordering such reduction directs that he shall take rank in such lower service, class, category or grade, next below any specified member thereof".

 

  1. Based on the above rules, as per G.O.Ms.(2D) No. 9 MA&WS Department dated 22.1.97 the Government issued orders to revise the seniority list pubished by the Director of Town Panchayats Proceedings Rc.No.20826/90/A3 Dated 7.4.92

 

  1. Accordingly, the Director of Town Panchayats revised the seniority list already published in proceedings Rc.20826/90/A3 Dated 7.4.92 vide proceedings Roc.23209/96/A1 Dated 17.2.97 as per rule 35( c ) Tamilnadu State Subordinate Rules and hence, the revised seniority published by the Director of Town Panchayats is in order.
